Terms of Use for ExDetox

1. Acceptance of Terms

Welcome to ExDetox! These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ExDetox ("we," "us," or "our") governing your access to and use of the ExDetox mobile application (the "App").

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. Eligibility

Age Requirements

You must be at least 17 years of age to use ExDetox. By using the App, you represent and warrant that you meet this age requirement.

Capacity

You represent that you have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Description of Service

ExDetox is a personal wellness and recovery application designed to help users:

Track their recovery journey from past relationships

Maintain no-contact streaks

Monitor emotional wellness through daily check-ins

Access motivational content and educational resources

Utilize AI-powered coaching and support

Practice mindfulness through guided breathing exercises

Track personal growth milestones and achievements

4. License and Restrictions

Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device solely for your personal, non-commercial use.

Restrictions

You agree NOT to:

Copy, modify, adapt, translate, or create derivative works of the App

Reverse engineer, decompile, disassemble, or attempt to discover the source code

Rent, lease, sell, sublicense, distribute, or transfer the App to any third party

Remove, alter, or obscure any proprietary notices on the App

Use the App for any illegal, unauthorized, or prohibited purpose

Attempt to gain unauthorized access to any portion of the App or related systems

Use automated scripts, bots, or other automated means to access the App

Interfere with or disrupt the App's functionality or servers

Use the App to harass, abuse, or harm another person

Impersonate any person or entity or misrepresent your affiliation

5. User Content and Data

Your Content

You retain ownership of all content you create, upload, or input into the App, including:

Personal notes and journal entries

Daily check-in data

"Why" lists and personal reasons

Chat messages with the AI agent

License to Your Content

By creating content in the App, you grant us a limited license to use, store, and process your content solely to provide and improve the App's functionality and to deliver services you request (such as AI responses).

Content Standards

You agree that all content you create or input will:

Be accurate to the best of your knowledge

Not violate any laws, regulations, or third-party rights

Not contain harmful, threatening, abusive, or illegal material

Not contain content that promotes self-harm or harm to others

Data Responsibility

You are solely responsible for:

Maintaining the confidentiality of your device and App access

All activities that occur through your use of the App

Creating backups of any important data you store in the App

Any consequences resulting from your use or misuse of the App

6. AI-Powered Features

Nature of AI Service

The AI chat feature in ExDetox uses artificial intelligence to provide conversational support. You acknowledge and agree that:

AI responses are generated by algorithms and may not always be accurate or appropriate

AI advice is not a substitute for professional mental health care, therapy, or medical advice

We do not guarantee the accuracy, completeness, or usefulness of AI-generated content

AI interactions are processed through third-party services (OpenAI)

AI Usage Guidelines

When using AI features, you must:

Use the service responsibly and ethically

Not attempt to manipulate, exploit, or abuse the AI system

Not use the AI to generate harmful, illegal, or inappropriate content

Understand that AI responses are based on patterns and may lack human judgment

7. Health and Wellness Disclaimer

Not Medical or Therapeutic Advice

ExDetox is a self-help and wellness tool. IT IS NOT:

A substitute for professional mental health care, therapy, or counseling

Medical advice, diagnosis, or treatment

A crisis intervention service

A replacement for professional relationship counseling

No Professional Relationship

Use of the App does not create a doctor-patient, therapist-client, or any professional healthcare relationship between you and ExDetox or its developers.

Emergency Situations

If you are experiencing a mental health emergency, suicidal thoughts, or are in crisis, DO NOT rely on ExDetox. Instead:

Call emergency services (911 in the US)

Contact the National Suicide Prevention Lifeline: 988 (US)

Visit your nearest emergency room

Contact a mental health professional immediately

Seek Professional Help

We strongly encourage users who are struggling with:

Depression, anxiety, or other mental health conditions

Thoughts of self-harm or suicide

Abusive relationships or domestic violence

Substance abuse issues

Severe emotional distress

...to seek help from qualified mental health professionals, counselors, or support organizations.

8. Third-Party Services

OpenAI Integration

The App uses OpenAI's API for AI chat functionality. Your use of this feature is also subject to OpenAI's Terms of Use and Privacy Policy. We are not responsible for OpenAI's services or any issues arising from their use.

Third-Party Links

The App may contain links to third-party websites, resources, or services. We do not endorse and are not responsible for:

The content, accuracy, or availability of third-party resources

Any products, services, or content available through third-party links

Your interactions with third-party services

App Store

Your use of the App is also subject to Apple's App Store Terms of Service and any applicable agreements with Apple.

9. Intellectual Property

Our Rights

ExDetox, including its design, features, graphics, user interface, content, and underlying technology, is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you are reserved by us.

Trademarks

"ExDetox" and all related logos, product names, and service names are trademarks or registered trademarks of ExDetox. You may not use these marks without our prior written permission.

Feedback

If you provide us with feedback, suggestions, or ideas about the App, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback into our products and services without any obligation to you.

10. Payment and Subscriptions

Current Model

As of the Last Updated date above, ExDetox is provided free of charge. We reserve the right to introduce paid features, subscriptions, or in-app purchases in the future.

Future Paid Features

If we introduce paid features:

We will provide clear notice and pricing information

You will have the opportunity to accept or decline paid features

Separate payment terms will apply

Payments will be processed through Apple's in-app purchase system

11. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you also agree to our Privacy Policy.

12. Updates and Modifications

App Updates

We may release updates, patches, or new versions of the App from time to time. These updates may:

Add new features or functionality

Fix bugs or security vulnerabilities

Modify or remove existing features

Be required for continued use of the App

Terms Updates

We reserve the right to modify these Terms at any time. When we make material changes:

13. Account and Data Management

No Centralized Accounts

ExDetox does not currently require account creation or login. All data is stored locally on your device.

Data Backup

You are responsible for:

Maintaining your iOS device and backups

Understanding that uninstalling the App will delete locally stored data

Creating your own backups of important information

Data Reset

You may reset your progress and data at any time through the App's settings. This action is irreversible.

14. Termination

Your Rights

You may stop using the App at any time by uninstalling it from your device.

Our Rights

We reserve the right to:

Suspend or terminate your access to the App at any time, with or without notice

Discontinue the App or any features at our discretion

Refuse service to anyone for any reason

Effect of Termination

Upon termination:

Your license to use the App immediately ends

You must delete the App from all devices

Provisions of these Terms that by their nature should survive will survive termination

15. Disclaimers

"AS IS" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY

FITNESS FOR A PARTICULAR PURPOSE

NON-INFRINGEMENT

ACCURACY OR RELIABILITY

UNINTERRUPTED OR ERROR-FREE OPERATION

FREEDOM FROM VIRUSES OR HARMFUL COMPONENTS

No Guarantee of Results

We do not guarantee that:

The App will help you achieve your recovery goals

Using the App will result in any particular outcome

The App will meet your specific needs or expectations

The AI features will provide accurate or helpful responses

Your data will never be lost due to technical issues

Third-Party Content

We are not responsible for the accuracy, usefulness, or availability of any third-party content, including AI-generated responses.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

No Liability for Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, data, use, or goodwill

Emotional distress or psychological harm

Service interruption or data loss

Cost of substitute services

Any damages resulting from your use or inability to use the App

Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED $100 (ONE HUNDRED US DOLLARS) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Basis of Bargain

These limitations reflect the allocation of risk between us and are fundamental elements of the basis of the bargain between us. The App would not be provided without these limitations.

17. Indemnification

You agree to indemnify, defend, and hold harmless ExDetox, its developers, affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use or misuse of the App

Your violation of these Terms

Your violation of any rights of third parties

Your content or data submitted through the App

Any harm caused by your reliance on App content or AI responses

18. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.

Informal Resolution

Arbitration Agreement

Class Action Waiver

YOU AND EXDETOX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Exceptions to Arbitration

Notwithstanding the above, either party may seek equitable relief in court for infringement or misuse of intellectual property rights.

19. Geographic Restrictions

The App is controlled and operated from the United States. We make no representation that the App is appropriate or available for use outside the United States. Users who access the App from other locations do so at their own risk and are responsible for compliance with local laws.

20. Accessibility

We strive to make ExDetox accessible to all users. If you experience accessibility barriers while using the App, please contact us at [your-email@example.com] so we can work to improve accessibility.

21. Export Control

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce. You represent that you are not located in, under the control of, or a national or resident of any embargoed country.

22. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

23. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

24. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of ExDetox.

25. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us in the App, constitute the entire agreement between you and ExDetox regarding the App and supersede all prior agreements, understandings, and communications, whether written or oral.

26. Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms or any rights under these Terms without restriction.

28. Apple-Specific Terms

Acknowledgment

You acknowledge that these Terms are between you and ExDetox only, and not with Apple Inc. ("Apple"). ExDetox, not Apple, is solely responsible for the App and its content.

Scope of License

Your license to use the App is limited to a non-transferable license to use the App on an Apple-branded product running iOS that you own or control, as permitted by the Usage Rules in Apple's App Store Terms of Service.

Maintenance and Support

Apple has no obligation to provide maintenance or support services for the App. ExDetox is solely responsible for any product warranties.

Product Claims

ExDetox, not Apple, is responsible for addressing any claims you or third parties have relating to the App or your possession or use of the App.

Intellectual Property Claims

In the event of a third-party claim that the App infringes intellectual property rights, ExDetox, not Apple, is responsible for investigating, defending, settling, or discharging such claim.

Legal Compliance

You represent and warrant that:

You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country

You are not listed on any U.S. Government list of prohibited or restricted parties

Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.

Not use the App to promote or facilitate harmful behavior

Not share screenshots or content that could identify or harm others

Respect the privacy and dignity of your ex-partner and others

Use AI features responsibly and ethically

By using ExDetox, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy.
